Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the Fine Grade Concrete, Landscapes, and More - LLC ("Fine Grade," "we," "our," or "us") website and services. By accessing our website or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

Our Services

Fine Grade LLC provides landscaping, concrete work, and related services in the Boise, Idaho area. Our services include, but are not limited to:

  • Concrete installation and repair (patios, driveways, walkways)
  • Stamped and decorative concrete
  • Retaining walls and structural work
  • Landscaping design and installation
  • Irrigation and sprinkler systems
  • Outdoor living spaces (pergolas, fire pits)
  • Sod and lawn installation
  • General landscape maintenance

All services are subject to availability, weather conditions, and our professional judgment regarding feasibility and safety.

Quotes and Estimates

All quotes and estimates provided by Fine Grade LLC are:

  • Valid for 30 days from the date of issue unless otherwise specified
  • Subject to site inspection and may be adjusted based on unforeseen conditions
  • Not binding until a signed contract or work order is executed
  • Based on information provided by the client; changes to project scope may result in additional charges

Free estimates are provided for most projects. Detailed design work or complex planning may require a consultation fee, which will be discussed upfront.

Payment Terms

Payment terms will be outlined in your project contract and may include:

  • Deposit: A deposit (typically 25-50% of project cost) may be required before work begins
  • Progress Payments: For larger projects, payments may be scheduled at project milestones
  • Final Payment: Due upon completion and acceptance of work
  • Payment Methods: We accept cash, check, credit cards, and electronic transfers

Late payments may be subject to a finance charge of 1.5% per month (18% per year) or the maximum allowed by law. Unpaid balances over 60 days may be sent to collections.

Project Timeline and Delays

While we strive to complete projects within estimated timeframes, actual completion may be affected by:

  • Weather conditions
  • Material availability
  • Permit delays
  • Unforeseen site conditions
  • Changes to project scope
  • Acts of God or circumstances beyond our control

We will communicate any significant delays promptly and work to minimize impact on your project timeline.

Warranties and Guarantees

Fine Grade LLC stands behind our work with the following warranties:

  • Workmanship: We guarantee our workmanship for one (1) year from project completion
  • Materials: Materials are covered by manufacturer warranties, which we will assist in facilitating
  • Structural Work: Concrete and structural work carries specific warranties outlined in your contract

Warranties do not cover:

  • Damage caused by improper maintenance or use
  • Normal wear and tear
  • Damage from acts of nature (flooding, earthquakes, etc.)
  • Modifications made by others after project completion
  • Issues arising from failure to follow maintenance instructions

Cancellation and Refunds

Client Cancellation: If you cancel a project after work has begun, you will be charged for:

  • All work completed to date
  • Materials ordered or purchased
  • A cancellation fee to cover administrative costs and lost revenue

Cancellations made before work begins may result in forfeiture of the deposit, depending on expenses already incurred.

Our Right to Cancel: We reserve the right to cancel or refuse service if site conditions are unsafe, permits cannot be obtained, or the client breaches these Terms.

Limitation of Liability

Fine Grade LLC maintains appropriate insurance coverage for our operations. Our liability is limited to the cost of repair or replacement of defective work, up to the amount paid for the affected portion of the project.

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use, revenue, or profit
  • Damage to underground utilities not properly marked
  • Pre-existing conditions not disclosed during site inspection
  • Acts of third parties or natural disasters

Client Responsibilities

As our client, you agree to:

  • Provide accurate information about your property and project needs
  • Obtain any necessary homeowner association approvals
  • Ensure access to the work site during scheduled work hours
  • Remove or secure pets and valuables from the work area
  • Arrange for utilities to be marked before excavation (call 811)
  • Make timely payments according to the contract schedule
  • Review and approve plans and material selections promptly
  • Notify us immediately of any concerns during the project

Permits and Regulations

We will obtain necessary permits for work where required. Permit fees are separate from the project cost unless specifically included in your quote. You are responsible for ensuring that the project complies with any deed restrictions, HOA rules, or easements affecting your property.

Intellectual Property

All designs, plans, photographs, and materials created by Fine Grade LLC remain our intellectual property. We may use photos of completed projects for marketing purposes unless you specifically request otherwise in writing.

Dispute Resolution

In the event of a dispute, we encourage communication to resolve issues amicably. If resolution cannot be reached through discussion:

  • Disputes under $10,000 shall be resolved through mediation in Ada County, Idaho
  • Larger disputes may be subject to binding arbitration or legal action in Ada County, Idaho
  • The prevailing party may be entitled to recover attorney fees

Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any legal action related to these Terms or our services must be brought in the courts of Ada County, Idaho.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
